Even though family is often a source of joy, it is not uncommon for clients to need prompt legal advice and representation to avoid or resolve disputes. Often, the interests of one or more children are endangered and violated, which is referred to as child welfare risks.
The welfare of a/the child is the central principle of child custody law—it includes criteria such as the adequate care of the child, the protection of the child’s physical and mental integrity, the promotion of the child’s development opportunities, and reliable contact with both parents, which is usually also in the best interests of the child.
Family law also consists of the sub-areas of custody, contact rights, and parentage.
In the case of cohabiting couples, there is often no legal regulation (division of property, legal assumptions, relaxation of the burden of proof, etc.) in place to ensure, as in marriage law/Marriage Act or the Registered Partnership Act, to ensure that questions about rights and obligations in the cohabitation, asset management of the partners or within the cohabitation, and the dissolution of a cohabitation can be answered clearly.
There are also no regulations on the subject of maintenance. From a legal point of view, cohabiting partners are considered strangers by the highest courts. This highlights the need for you to act as a cohabiting partner when important joint decisions or investments are pending or have been made.
